1. Introduction and Acceptance of Terms

Miles Better provides an AI-powered race coaching software (M1LES BETTER AI) that analyzes user driving inputs and telemetry data, compares it against reference laps, and delivers real-time, actionable feedback.

• Updates: We continuously update the AI models, software features, and reference laps. We reserve the right to modify, suspend, or discontinue any part of the Service at any time without prior notice.

3. User Accounts and Security

To access M1LES BETTER AI, you must register for an account.

• Accuracy: You agree to provide current, accurate, and complete information during registration.

• Security: You are responsible for safeguarding your login credentials. You agree not to share your account or subscription with third parties. Miles Better is not liable for any loss or damage arising from unauthorized access to your account.

• Account Termination: We reserve the right to suspend or terminate your account at our sole discretion if we suspect a breach of these Terms, unauthorized sharing of accounts, or fraudulent activity.

4. Subscription Plans, Billing, and Cancellation

Access to M1LES BETTER AI requires an active subscription.

• Billing: By selecting a subscription plan, you authorize us (and our third-party payment processors) to charge your payment method for the applicable recurring subscription fees (monthly or annually, as selected).

• Auto-Renewal: Your subscription will automatically renew at the end of each billing cycle unless you cancel it before the renewal date.

• Cancellation: You may cancel your subscription at any time via your account dashboard. Cancellation will take effect at the end of your current paid billing period.

• Refunds: Unless otherwise required by law, all subscription fees are non-refundable. We do not provide refunds or credits for partial subscription periods or unused Services.

5. Acceptable Use and Software License

Subject to your compliance with these Terms and payment of applicable fees, Miles Better grants you a limited, non-exclusive, non-transferable, revocable license to use the Service for your personal, non-commercial use. You agree NOT to:

• Reverse engineer, decompile, or disassemble the M1LES BETTER AI software.

• Extract, scrape, or harvest reference lap data, AI coaching models, or proprietary telemetry algorithms.

• Use the Service to develop a competing product.

• Attempt to bypass any security measures, rate limits, or licensing checks embedded in the Service.

6. Telemetry Data and Privacy

To function, M1LES BETTER AI requires the collection and processing of your driving telemetry (e.g., speed, braking, steering input, track position).

• Data Processing: By using the Service, you grant us the right to collect, store, and process your telemetry data to provide coaching feedback.

• Anonymized Data: We reserve the right to aggregate and anonymize user telemetry data to improve our AI models, develop new reference laps, and enhance the overall Service.

7. Intellectual Property

All intellectual property rights in the Service, including but not limited to the M1LES BETTER AI algorithms, software code, user interface, reference lap databases, trademarks, and branding, are the exclusive property of Miles Better. 8. Disclaimer of Warranties (Crucial Clause)

The Service is provided on an "AS IS" and "AS AVAILABLE" basis. Miles Better makes no warranties, express or implied, regarding the accuracy, reliability, or availability of the AI coaching.

• No Guarantee of Results: While M1LES BETTER AI is designed to improve driving performance, we do not guarantee specific results, lap times, or that you will reach "alien pace."

• Not a Substitute for Professional Instruction: The Service provides automated, algorithmic feedback. It is strictly for entertainment and educational purposes within simulated environments.

9. Limitation of Liability

To the maximum extent permitted by applicable law, Miles Better, its directors, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.

• Hardware/Property Damage: We accept absolutely no liability for any damage to your simulator hardware, PC components, or real-world vehicles (if the software is used in a real-world track setting) resulting from attempting to follow M1LES BETTER AI coaching instructions.

• Maximum Liability: In no event shall our total liability to you for all damages exceed the amount you paid for the Service in the twelve (12) months preceding the claim.

10. Third-Party Integrations

M1LES BETTER AI may interact with third-party simulation software (e.g., iRacing, Assetto Corsa Competizione, etc.). We are not affiliated with these third parties. You are solely responsible for ensuring that your use of our Service complies with the Terms of Service of any third-party simulator you use.

We may revise these Terms from time to time. If we make material changes, we will notify you via email or through a prominent notice on the platform. Your continued use of the Service after the effective date of the revised Terms constitutes your acceptance of the changes.
